To comply with security requirements, she can only route classified information through a server that was certified as being secure enough for this purpose. That being the case, who certified that the server met prescribed security requirements? Where is the documentation showing that this certification process was completed? If this was not done, it represents a very serious security violation. Also, there is a requirement to maintain a backup server located in a different geographic area in the event the primary server was damaged as a result of fire, natural disaster, etc. If this requirement was not met, it represents yet another serious violation.
No, its not legal to send SECRET or TOP SECRET communications through a private server. It’s also practically impossible to do, since the SECRET and TS systems are not connected to the internet. All that traffic travels over its own network. I think that she was using her private system to send and receive unclassified email. That doesn’t mean that someone didn’t misuse the unclassified system to send classified information by typing it into the email and Hillary would have to be the top suspect for having done that. The higher up you are, the more likely you are to do it.
