What happened to the Administrative Procedure Act that requires publication of proposed rules followed by a period of public comment?

They did this before, and then changed the proposal without telling anyone what the changes are. This is not in compliance with the APA, and the rules should be void ab initio.

Will Republicans use the law to stop them, or gnash their teeth in false discombobulation for the cameras?

Words mean nothing.

Only actions matter.

Rush said next thing the FCC will do is issue “waivers.”

We’ve seen that before, too:

“From all indications, the FCC contemplates that the new rules will be sufficiently burdensome and costly — and sufficiently ambiguous — that affected parties will be invited to seek exemptions from the new mandates through “waiver” requests or other administrative mechanisms.”

Is the FCC lawless?
