The judge ordered the Travis County Clerk to stop relying on the “unconstitutional Texas prohibitions against same-sex marriage” as a basis for denying a marriage license to them.
Essentially, Sarah is dying very soon and Suzanne wants intestacy rights, homestead rights, community property rights, spousal support, and spousal evidentiary privileges in a wrongful death lawsuit when Sarah dies.
I believe any individual has the absolute right to leave his property, money, and medical decisions to whomever he wants, but that right does not entitle him to a marriage license. The law provides mechanisms for all of those rights.
A sad day for Texas but what do you expect with all the libs moving in.

This morning, a rogue state District Judge in Austin instructed the Travis County Clerk to certify a marriage license for a same sex couple. That license is invalid, just as any license issued in violation of state law would be.
I took immediate action, asking the Texas Supreme Court to stay this proceeding. This afternoon, the Texas Supreme Court granted my request to stay two court rulings that declared Texas marriage law unconstitutional. As Attorney General, I will continue to defend the will of the people of Texas, who have defined marriage as between one man and one woman, against any judicial activism or overreach.
Sarah needs to be making preparations for life after death rather than playing games!
