“Good question. I dont think there is an enforcement mechanism”
If specific violations can be found, drag those actually implementing a denied process or procedure ( like handing out documents ) and jail those individuals for being in violation of the judge’s order (it’s contempt of court and you go directly to jail on the judge’s order). Do it over and over, working your way up the food chain. Personally, I’d like to see that bastard Jeh Johnson in the slammer.
It might get that high on the foodchain, probably not higher.
They said in the article that Obama has an appeals judge in the 5th circuit ready to reverse the order.
Exactly!
Obama can ignore this if he wishes, but the onus is now on the minions. Legal jeopardy accrues to anyone who signs up an illegal for legal job status. Enforcement mechanism? The judge declared the states to have standing, the "mechanism" then, will reside with the states, and I cannot see them not enforcing with a degree of urgency.
Yes, Obama will want to defy the ruling, but will those within the agencies risk prosecution? I don't think so, and that's why this is a bigger deal than it might seem.
I realize this is only a temporary injunction, an appeal has already been filed I'm sure, but it goes to the Fifth Circuit in New Orleans, largely composed of Reagan and HW Bush appointees.
If this does produce a win for the good guys, then we will see how important it was in 2010 and 2014 that we won the governorships and state houses.
