LTC Peters is treading near a violation of ART 88, UCMJ Contempt toward officials, assuming he is Regular Army and not USAR. The truth or falsity of the statements is immaterial.
He’s retired. LTC Peters can be recalled to active duty for the purpose of court-martial only if evidence emerges of his violating UCMJ prior to retirement.
As a warrant officer I was threatened with Article 88 for badmouthing Bill Clinton, and I was a reservist! OK sir, I told the CO, I’ll keep my mouth shut during weekend drills. He insisted the prohibition applied for as long as I was an active reservist, anytime of the month (yeah, right).
Anyway, Article 88 was added to UCMJ in 1867 to prevent Union generals with political ambitions from attacking President Andrew Johnson who was unpopular at the time.
We military retirees are free to speak our minds.

I quit a job over a safety issue at a nuclear power plant, severing my alliance with a trade union, cutting my pension in half. Sometime's one must act in spite of the personal consequences.

My ex-wife was having an affair with a warrant officer, who received zero administrative or punitive punishment, and went on to draw a lifetime pension. I got out of the service, eventually getting custody of my son. If it went another way, some people might not be breathing today.
I despise the Officer Corps. and the JAG branch in particular.
When the SHTF, things aren't going to go well for those that think things are going to go well for them. It's going to be extremely difficult to find an unused lamp post.
Feck.. I think the Col. is retired and smart enough to know what he can say and get away with it. I certainly hope so.
