Krauthammer: Decision not to indict NYPD officer 'totally incomprehensible'

Charles Krauthammer said Wednesday on "Special Report with Bret Baier" that a grand jury's decision not to indict a New York City police officer in the death of Eric Garner, an unarmed black man who died in July after the officer placed him in a chokehold, is "totally incomprehensible."

"It looks like they at least might have indicted him on something like involuntary manslaughter at the very least," Krauthammer, a syndicated columnist and Fox News contributor, said. "The guy was unarmed, and the crime was petty as they come. He was selling loose cigarettes, which in and of itself is almost absurd that somebody has to die over that."

...they should have just written him a ticket.

Do we know that they didn't try to write him a ticket?

BTW, I think he was out on probation for one or several of his 31 previous arrests, so a simple ticket may not have been appropriate.

The way I look at it, cops usually just experience crappy people day in and day out. Therefore, I tread lightly. You never know how their day went. I sure as hell would not be walking down a 4 lane main street after committing a robbery and then have the nerve to attack an armed cop. That is suicide.

Garner was just a weak (character) small time crook who had he been taught good manners and practiced those good manners would be alive today. The cops were heavy handed from my POV and Garner is dead. Very very sad. I can understand the anger.

Correct.

This man died because he was resisting arrest and is obese and many other things.

This is an unfortunate accidental death.

Not death by choking.

What’s the difference between taxing cigarettes and taxing tea? The dead guy was doing the right thing.

The man died because he reacted poorly at being caught breaking a silly damn law. Whether he is obese is beside the point. Having five policemen on top of him looks bad. The PR is a nightmare.

The race baiters make everything a PR nightmare. Who cares anymore. The overreaction is getting really old really quick to many Americans.

No indictment. The grand jury heard evidence that led them to their decision. I’m already sick of hearing about this.

Obama is loving this baloney.

There have to be consequences. The fact that there isn’t proves they are above the law themselves. That’s dangerous. From what I have heard of this case an involuntary manslaughter verdict would have been applicable. IS there something we don’t know maybe? The man said he could not breathe, more than once. I don’t understand why they use such excessive force:(

RE:”BUT he could breathe.
So if I lie and say a cop is choking me and he isn’t...I am right and the cop is wrong? Just because I said it?”

It depends on if you die while pleading for the police to stop choking you on cam like he appeared to be. You are obviously alive to post this so your hypothetical doesn't seem realistic.

chris37, thanks for the pic, that's even MORE damning adding to his pleas.

I don’t know how anyone can say it wasn’t when that is what the cause of death was ruled!

But he didn’t die when saying “I can’t breathe”.

That is a fact.

A caller, who must have been a LEO, said the exact same thing - what are we supposed to do? Give them our business cards?

he has a good point.

then why is he dead? he was standing there alive, the police took him down, he said he couldn’t breathe and now he is dead.

maybe it wasn’t the choke hold itself but it was something that they did to him - or was he about to die right then and there whether the police were there or not?

From what I can tell being such a large man being pressed between the sidewalk in combination with his weight and the police pressing done on him constricted his rib cage and prevented him from breathing.

But I do not know that to be the case, that is just my suspicion. He was obese and had circulatory problems.

This was an accidental death.

It wasn’t intentional.

It wasn’t a white cop riding around looking for a black man to choke.

Problem for me is that he started this confrontation, and he escalated it.

He is responsible for his death.

If you haven;t heard of the death of homeless man Kelly Thomas by cops look it up and watch the video. I couldn’t listen to it only watched with sound down. I read he was calling for his dad and shouting help, they’re killing me. Heartbreaking. He was mentally ill man being wrongly questioned about looking in cars to break in them, and if you see the picture of how beat up he was at the hospital before he passed away you will feel sick. Oh and yeah, the cops got off. people were astonished when verdict came in.

-> Those facts indicate negligence or recklessness, which were a component to many of the charges, yes.

How can anyone deem what was reckless / I wasn’t there holding down the 400 pound man (accidental, yes). I wonder if this is emotional thinking / the picture of the cops over top of a suspect. The jury didn’t see this as reckless apparently. True bill. They have more evidence than we do. When a person is told to calm down, move, put your hands behind your back, why resist / most of the times, a person isn’t going to win because the officer (s) could assume one meant to do them or someone else bodily harm.

I am reading conflicting messages on twitter than the man had a heart attack (due to the hold and his poor health) I’d like to wait to hear more info. I think it was irresponsible for Charles to say what he did without the testimony of the witnesses being released. The prosecutor is trying to get that released but the mayor says no..

Of course, I feel sympathy since there is a loss of life. The victim has been warned a number of times do not sell these cigarettes there. 8 tickets or alike. In the beginning, he was combative. I wish it turned out differently for both sides. I can’t see the cops went in to deliberately to kill this poor man.

The police weren’t choking him.

And you’re welcome for the pic, it’s exculpatory evidence.

If you want to educate yourself and learn what a choke hold looks like, look at post 69.

The thing that kills the NYC police is his repeated crying “I cannot breath. I cannot breath. I cannot breath”

He should have just kept his mouth shut. It wouldn't seem so bad then.
