This matters in King v. Burwell. The IRS has decided that subsidies should be paid to residents of states that have failed to set up exchanges, i.e., that Congress made a typo when they wrote the opposite in the law. King v. Burwell aims to force the law to be enforced as written. Of course, the 'Rats are arguing that it is indeed a typo how could they have been so stupid as to write the law that way deliberately?
However, Gruber shows that it was not a typo, just a failed political calculation. The 'Rats thought the provision would force the states to set up exchanges. They didn't anticipate their bluff being called. Thus, the law is indeed the law, and must be enforced!
