He wasn't talking about the legitimacy of the claim. That's not an issue here.

We haven't reached the point where US courts decide whether foreign governments' claims to foreign territory are legitimate.

What they're talking about is who in our own government gets to decide what we recognize and what we don't, the executive or the legislative branch.

The headline writer is just trying to stir up attention.
