Judge denies injunction request from Grimes to halt RPK/McConnell mailers

A Franklin Circuit Court judge denied a request from Democratic U.S. Senate candidate Alison Lundergan Grimes to stop the Republican Party of Kentucky and the campaign for U.S. Sen. Mitch McConnell from sending mailers that Grimes called a bullying tactic.

On Monday morning Franklin Circuit Judge Phillip Shepherd denied Grimes’ request to halt the mailing of the fliers which say “the information enclosed contains facts related to a possible fraud perpetrated on citizens across Kentucky.”

Within the mailer it refers to statements in Grimes’ ads media fact checkers have criticized, such as a claim that U.S. Sen. Mitch McConnell didn’t fight to save an eastern Kentucky coal-fired power plant.

Republican Party of Kentucky spokeswoman Kelsey Cooper called the legal fight a “publicity stunt.”

“Her sloppy lawsuit may go down in history as one of the worst publicity stunts of all time,” Cooper said.

Jonathan Hurst, campaign manager for Grimes, called the mailers “reprehensible” saying McConnell is “celebrating lying, intimidating, and bullying Kentucky voters from exercising their right to vote.”

“There’s no low too low for Mitch McConnell in his personal quest for power. These tactics are beneath any candidate for public office — much less those vying for Kentucky’s U.S. Senate seat. Voters will see through these deceptions, just as they’ve seen through the over $50 million in false attacks against Alison, and will vote to end McConnell’s 30-year record of failure in Washington,” Hurst said.

In Shepherd’s denial he said the court lacks the jurisdiction to deny free speech.

Gee, who knew? Not sure how their request for an injunction could possibly have any effect anyway since they were already sent and received...LOL. It's "bullying" and "celebrating lying" to point out the lies of your opponent's campaign.

Did this happen today? Election day is tomorrow so to have any impact I assume these would have been mailed long ago anyway.

I would say that she had a marginal staff, some DC-provided handlers of questionable quality, and no sufficient help from the Kentucky news media.

If the state governor flips to Republican in 2015...McConnell retires and some other Republican gets appointed.
