If ever we need to unleash the 1stMarineDivision, California is the state. Then a military governor is appointed to clean out that sh*thole. After that, we enforce the 1867 Reconstruction Act to remove the governor and the state legislature. Next, the entire state congressional body is thrown out of the US Congress.
Finally, the idiot voters are given multiple chances to elect Americans who swear fealty to America and its Constitution.
I’m sure the state will be more than willing to pay an annual fee for the right to use the beach, patrol it and perform daily cleanup and maintenance.
Seems everyday this guy is signing some sort of new law into place. He continues to clamp down upon freedom and the people applaud. Were I the tin foil hat type I just might think California is the test case for the end goal of applying such freedom infringing laws nation wide. The ground zero of re-education camps. As it is, Californians continue to spread throughout other states infecting them with freedom restrictive laws.
Perhaps in addition to securing the Mexican border we should also be securing the California border.
This is more complicated than might be clear at first blush.
There is a public beach, which had access through the property.j
Courts have been clear that the right of access was continuous, and must be maintained. The owner decided to close it off anyway.
He subsequently lost in court, and was ordered to comply and negotiate a reasonable public point of access to this public beach.
The law signed today basically says that if the negotiations fail or are overly delayed, that the state government is authorized to use eminent domain to seize the property and create the ordered public access corridor.
This is not an assault on private property rights. The permissive easement has been shown to exist for decades, and was known about when he purchased the land. He erected gates and posted armed guards trying to effectively turn a public beach into his own private beach by cutting off public access.
Also, this is probably the better solution... where he could sell the access throughway rather than live with a section of his property being an easement.
This is not one of moonbeam Jerry’s crazy communist plots.
This sounds like a 5th Amendment applied to the states by the 14th Amendment issue to me. If California wants to decide policy for the land’s use against the owners wishes then California can buy the property.
The weak California Republican party hasn’t put anybody worth voting for in front of the people in quite some time much less put any effort into getting what they do put forth elected.
Jerry Brown therefore is feeling his oats.
