Dallas County Judge Clay Jenkins personally escorted the family of Ebola carrier Thomas Duncan to a 4 bedroom spacious home in a gated community Friday. It’s where they will live, miles away from their cramped apartment in Dallas while under quarantine.

So where does Jenkins get his authority? Is it because he is Homeland Security and Emergency Management director? Cantrell doesn’t think so. “There’s been no declared emergency at the federal, state, or county level. I don’t know where he’s getting his authority.”
Dallas attorney Clint David says Jenkins has some pro-active power as emergency preparedness director, through state Homeland Security and Emergency Management laws, or HESM.

Chapter 418 of the Texas Government Code states the county judge is responsible for the county’s emergency preparedness and is the only one who can declare a disaster in their respective counties.

In the Ebola case in Dallas, authorities at the state, county and city levels are working with the CDC.
Specifically, it’s Dallas County that’s in charge, said Dallas County Judge Clay Jenkins, also director of the county’s Homeland Security and Emergency Management.
The county has “set up an Incident Management Center and is acting as the lead agency for the Ebola investigation and containment,” said the county judge, who is vested with broad judicial and administrative powers under the Texas Constitution.
Who Is Clay Jenkins?

Forgive my ignorance, but aren’t Judges supposed to be impartial? I must be missing a big piece of this puzzle.
