That's not a problem. You said this:

How does one have consensual sex when they are incapacitated? It may be agreed to not report it by mutual consent, but by definition, how is this possible?

Tell me what should be done with this:

A man gets drunk and sleeps with a sober woman who doesn’t use birth control. She gets pregnant from that man. Did he willfully become a father? Should he pay child support until that child is an adult?
