OK so he was a retired chief warrant officer. Since his conviction took place in a civilian federal court I assume he collected his pension until he died?

I always hated that. The investigation revealed that he spied during his time on active duty, and even back to the Vietnam war. The UCMJ (Uniform Code of Military Justice) states that the penalty for spying in time of war is DEATH.

He should have been court marshalled and shot.
