They are a “non State entity”...we can’t be at war with them.
Which allows greater leeway in wiping them out.
But the ISIL IS a national entity - they have said so themselves. And they have declared war on the entity once known as “the United States of America”.
There is some question whether the territory once known as “the United States of America” is in fact still a nation, as the term is defined. No borders, no leadership, chaos in the heartland, and apparently no body of governing principles.

Even more leeway than against the Barbary Pirates...except we have even less will to do so, and an even more feckless State Dept. than at that time (see Jefferson’s War - a great read on that part of history).
