Charge him with vandalism and if convicted, give him the max, hate crime is so stupid. I don't particularly like the "hate" crime concept, but it probably fits here. This is clearly intimidation, not graffiti, in fact the perp has delivered a clear death threat. I would assume there are other charges in California which could have fit the actions, including assault since a threat was made, but if a hate crime charge fits best, in instances like this imo that's OK.

There are many real crimes this idiot could be charged with and if convicted, receive the maximum sentence for each of them and he would and should spend some serious time in jail. The whole concept of "hate crimes" reeks of "thought crimes" and doesn't belong in our Republic, not to mention that it is applied
almost exclusively to white on black & perverts crimes.
It's a "get whitey" & "homophobes" concept, for the most part and should be abolished.
