If that is true and I was on the jury I would have no problem with finding him guilty. Just because he has a tow truck doesn't give him the right to go vigilante and tow anyone he sees parking illegally and charge people to get them back. Around here, parking lots with towing contracts are pretty clearly marked. Fortunately I've never had a car towed even when I parked in one of them.
Some times the owners of the lots will even cover the signs and allow parking in the non-business hours for a major event to be friendly to attendees.

I do not believe that he would tow without a valid contract.
However, I do believe that the authorities will make his contract disappear and that they will try to convict him on a technicality.
