I should point out that I believe the hack lawyers advising Governor Rick Perry in Texas are getting their law from the editorial pages of the New York Times and from the Huffington Post, rather than from the law books.

… has no-one read the TX Constitution on this matter?

TX Constitution, Art 4, Sec. 7. COMMANDER-IN-CHIEF OF MILITARY FORCES; CALLING FORTH MILITIA.
He shall be Commander-in-Chief of the military forces of the State, except when they are called into actual service of the United States. He shall have power to call forth the militia to execute the laws of the State, to suppress insurrections, and to repel invasions.

I have, just keep posting it and pointing it out. It's important that people know and understand it.
The weak points are AZ and CA, but once their constituants see Texas taking aim, they might
follow suit. Bah, who am I kidding, Perry is a screaming pansy hooked on Pharmaceuticals.
