I remember hearing someplace reputable that if you pay taxes—as opposed to receiving a refund—whether you pay the fine is up to you. As hard as it is to believe, the IRS has no recourse.
This is just my opinion, and subject to change. Act on it at your own risk, laplata. I’ve got a real problem paying a fine for something I never wanted, and I pay eno— *too much already* in taxes to those bloodsuckers.

That’s pretty much correct. There were a few Democrats that would only support the law if the IRS had limited enforcement power for those penalties - they didn’t want the IRS taking peoples’ houses away and cleaning out bank accounts because they didn’t buy Obamacare - not good optics.

And so they wrote the law to limit IRS to only less painful methods, which might be only grabbing refunds. You can still have the judgment against you for non-payment of taxes (which can cause its own problems), but the IRS cannot collect the Obamacare penalty until you have a refund due. And while most people can prevent refunds if they have a stable job, sometimes life gets in the way, like a capital gain, and you will get a refund - and bamm, they get it instead.

But none of that really matters...they NEVER could have INTENDED the law to mean that, so they’ll just IGNORE those words (as they are now doing/saying about subsidies for the federal exchanges) and find some corrupt (i.e., Democrat) judges to go along. So don’t count on the wording of the law meaning anything.

Here is what I expect to happen. Let's say that you owe $2000 in Taxes and $1000 in Obamacare “penalties”. You pay the IRS $2000. The IRS will credit the first $1000 to the OB Care penalty and the $1000 left over to the regular taxes. You now owe the IRS $1000. The balance due is not for the penalty but the regular taxes and is subject to penalties and interest and enforcement action. You are not allowed to tell the IRS where monies paid in are allowed to go.
