It has nothing to do with judgment. This was on a standard flight plan approved by all the countries on the route. There is a daily flight from Amsterdam to KL along the same route. I am sure there are many commercial airline flights over Ukraine daily.
At 33,000 feet, there should be no confusion that this was a military flight. MH 17 was flying its normal, daily route.
