That is where it gets interesting. Since Lerner would be held in custody for contempt of Congress, there may not be a conviction for Obama to pardon. If so, then Lerner might be held in the custody of the House of Representatives at the Capitol jail for contempt until after Obama leaves office; and then she could perhaps be indicted, prosecuted, convicted, and sent to Federal prison on other charges without a Democrat President to pardon her.
Not if he's in the cell next door. (A man can dream.)
