Lois Lerner has no records of two years of missing emails and Republican claims that she’s hiding something are “silly,” her lawyer said in his first interview since the controversy around the former IRS official erupted two weeks ago.

“She doesn’t know what happened,” lawyer William Taylor III said of the 2011 computer crash that erased two years worth of Lerner’s correspondence. “It’s a little brazen to think she did this on purpose.”

No "she didn't destroy the hard drives and then the backup tapes." She's not smart enough to do that, she is merely the hatchet person for the IRS against conservative groups and elected Republican congresspeople!

She's also too important to do such menial things like erasing emails and wiping hard drives, then realizing they could be reconstituted, takes a hammer to them.

The entire Administration are an evil bunch, along with the IRS, but the actual dirty work (like Islamic terrorists, they "have others to fasten bomb belts and go stand in the middle of an Israeli shopping center, bus or grade school!")

They don't want any blood left on their hands, they use other people, lower down on the food chain, whom they can blame and toss under the bus - if necessary.

This bunch, while certainly devious, don't have the smarts to pull off tracking down emails to erase then destroy hard drives on which they would be stored, they have their "people" to do the actual heavy lifting when it comes to tracking down incriminating records in which lead directly to Obama himself!

Again, emails are not just stored on a local hard drive. They are primarily stored on a central email server. This allows multiple devices, like her PC and her Blackberry to access them.

My laptop hard drive crashed last year. All I did was log on to my new laptop as me and ALL of my historical emails downloaded to it from the email server. Didn’t lose a thing.

Also, most email servers archive messages after 90 days.

When will someone point out that emails are NOT stored on employees' local hard drives in larger companies (like the US government). Emails are stored on a central email server (such as an exchange server).

According to their IT policy, they had a size limit on user Exchange/Outlook mailboxes. So if the mailbox got full, the user would have to clean it up, by doing one of two things - 1.) archive old emails (they wanted to save) or 2.) delete them entirely.

Archive emails can be placed on the local hard drive/ outlook folder and do not get synced or backed up to server.

My theory is that in June she archived every damning email from the server down to her hard drive. And then destroyed her hard drive. But!! The emails would have still been part of the 6 month backup tapes, as they are simply snapshots of every mailbox on the Exchange server. But they admitted they didn't restore using the tapes. And once 6 months expired, they were gone. Very conveniently.

That said, an IT investigator expert could still locate every email by the way of log files, address book (who did she send emails to, and subpoena them all), blackberry server and logs, ISP files/logs, purchase orders of storage media (drives/thumb drives/CDs), names of every IT person and their logs who worked on hard drive and installed new drive, etc.

You would think that would be common knowledge that emails are stored on servers.

Just a little reminder about what the function of a defense lawyer is; to protect the client! In this role the lawyer cannot knowingly lie IN COURT or in LEGAL DOCUMENTS, beyond that - fair game!

So I equate a lawyer with a hired Public Relations Flack or a hired gun slinger, truth is not their goal, protection of the client is the goal.

Of course the fact that most of elected government is full of lawyers is a good thing, RIGHT?

It's clearly done on purpose. Supposedly they have a policy that calls for printing out official business emails. Which is ambiguous at best. And it's at the agent's determination. If it's incriminating do you think the agent is going to print it out? Right! And secondly, the idea, in this digital age and government green agenda (when storage is so cheap), they'd print out on paper instead of digitally storing it is so laughable. Oops, spilled coffee on it.

Bottomline, the IRS is nothing but a legal criminal organization. And we know that destroying evidence is task #1 of most organized crime operations. This wasn't a policy that slipped through the cracks. They are always getting sued. And what better protection than having no evidence.

My experience is with a local school district.(Now retired)
(3 large High Schools, and umteen middle and elementary schools)
We, due to costs, had our teachers and administrators archive their emails at the end of each school year to their respective hard drives, and the servers would be scrubbed.
They were advised to keep those archived emails on a external drive.
So potentially, if they didn't follow directions, they could lose a year's worth of emails.
That said, however, we have paid $400-$500 on occasion for drives to be recovered by a tech firm that specializes in data recovery. (a lawyer in the dist office didn't do as directed) But if she got the Blue screen of Death, the drive didn't "Crash", Windows XP did !.. Data can still be recovered in house,if we at a local school dist can do this I'm sure the experts at IRS CIS surely can.

They broke a couple of laws (2, I think) by not properly backing up/storing information. They also didn’t report the hard drive “crashes” per the law to the proper people.
