Fox didn't need to put alleged in the title. If one is filing a suit one is alleging something. Using it is pejorative in the sense that it's only an allegation nothing proved yet so move on, nothing to see. It's like saying the suspect fired twice before fleeing. Well I would suspect him too. Duh!

While I agree that something should be done, taking it to _court_ is not the solution.
Part of what is _wrong_ with USG is courts have become the defacto determiner of USConstitution law, e.g., disputes between USG branches.
Congress is a supposed to be an independent power within USG. How can USCongress submit branch disputes to a _mere_ - other branch of USG? They should use their own ability to subpoena and prosecute, leading to arrest and impeachment of unlawful Executive branch agents and agencies.
At the _very_ least, USConstitution is clear that SCOTUS is the court of origin for USConstitution issues, which would include inter-branch disputes.

Boehner still shirking his Constitutional duty. The remedy is to file articles of impeachment. What the Senate chooses to do is irrelevant, it doesn’t excuse the House from doing their job. This is just political theater to get conservatives riled up for November. Obama doesn’t follow the Constitution, he could care less what a judge or court might say.

it will be up to Congress to impeach, try, and remove him. Agree. It isn't the duty of Scotus to fill in for congress. Thanks to the 17th Amendment we have redundant democratic houses in congress. All of them are wary of making any decision that could inflame the passions of any constituents and jeopardize their reelection this fall.
The hundred year effect of the 17th has made the congress institutionally incapable of doing its duty.
