“I should say. That sounds illegal.”

We addressed that and the legal department said that as long as that was the written policy and they adhered to it, it was legal. If you don’t keep the records they can’t be subpoenaed. And, given some of the things their tippy-top management committed to bytes I’d rather have a judge smack me for not keeping records and order me to keep them, rather than have a smoking t*rd show up in court. But, I any time I got something that smelled bad, I printed it out and took it home.

Whats really ironic is that, according to my accountant, the IRS’s requirement for small business owners to keep tax records - everything - is almost unlimited.
