Who was Obama rescuing: Bergdahl or the terrorists? Obama was rescuing himself.
He knew he was breaking the law by not giving Congress 30 days. He knew he was undermining the military and increasing chances our men would be kidnapped in the future. And Obama knew the guy he was trading for was marginal - not a hero - not a SEAL - and quite possible a traitor.
Obama knew the five men he was giving up were top killers.
Obama's in a tough spot politically since ObamaCare - and knows it. This move was high risk for him and his party. He knew that too. Yet he moved unilaterally. Several possibilities... for his actions...

Was Obama also aware he was willfully violating the USA PATRIOT Act as well, which prohibits, among other things, providing "expert advice and assistance" and "personnel" to terrorist organizations? Because that's exactly what he did in releasing these five terrorists back to the Taliban. And there is no exception for the President to Title VIII of the USA PATRIOT Act.
