Generally, a denial of cert does not indicate how SCOTUS would rule in a particular case and no opinion should be inferred. Because SCOTUS won’t hear Risen’s appeal, Holder can (but likely won’t) jail Risen. That doesn’t actually mean that SCOTUS sided with the government, but the end result is that the government wins.
