Once the cops declare the guy at fault being doped-up....it’s downhill from that point on. Sue the doper....due the shop that sold him the stuff....and sue the state for allowing an accident mentality to be prevalent. It’d even be better if you were a resident from Alabama....passing through the state, and drag them back to Alabama for the entire case.

Can be looked at another way as well:

Sue the drunk....due the distributor that sold him the alcohol....and sue the state for allowing an accident mentality to be prevalent.

And maybe it should be.

It will be the defense attorney asserting that claim, and diminished mental capacity is a valid defense in Colorado. And yes, I would love to see the “legal” pot industry sued out of existence for purveying substances that maim and kill.
