Nevada rancher's son freed, BLM collecting cattle

LAS VEGAS -- The son of a rural Nevada cattle rancher has been freed from federal custody, a day after his arrest by agents working to remove cattle from disputed grazing areas northeast of Las Vegas.

A U.S. attorney's office spokeswoman in Las Vegas said Monday that 37-year-old Dave Bundy is accused of refusing to disperse and resisting officers.Bundy's mother, Carol Bundy, says U.S. Bureau of Land Management agents arrested her son Sunday in a parked car on State Route 170 near Bunkerville.

Pictures obtained by the 8 News NOW I-Team show where David Bundy had parked his car to take pictures of the cattle eviction.

Bundy says he was only exercising his First Amendment rights when federal officers told him to leave  the area and when he didn't, they grabbed him."Two officers surround me, third one in front of me. They jumped me and took me to the ground. You can see they scraped up my face," Bundy said.Bundy's father, Cliven Bundy, says his cattle are entitled to graze in the Gold Butte area."They steal my cattle, and that is bad enough. But they make my son a political prisoner," Cliven Bundy said. 

This weekend wranglers, hired by the federal government, started  removing cattle owned by Bundy from a stretch of land near the Virgin River Gorge.

See this story about how a couple was forced to tear down their house, then get back to me about how generous the feds are:

You might want to research that story a little more deeply. They ended up winning a unanimous decision in the Washington State Supreme Court 13 years ago and live in their house today.

One other thing: The Columbia River Gorge Commission is a creature of the Washington and Oregon state governments. They fund it and staff it. The feds had nothing to do with the Bea's problems.

Agreed. To an extent...

I would prefer a Congressional committee to be set up to take a hard look at Art 1 Sec 8, the Bill of Rights, and all current Federal agencies. Using strict construction, go through each Agency and match it to an explicit reading of the operative article/amendment.

Any found to violate that strict reading would be immediately axed, their staff furloughed, buildings/assets sold to the public, and any criminal actions under their auspices prosecuted fully.

For some Federal agencies that most consider “vital” to our Nations health, free market private entities be given first shot at buying said assets/buildings. Such as a private version of NASA, FDA, or the FAA to be run much the same way Underwriters Laboratories or the IEEE is run.

Guess where the BLM falls under that “oversight”...

Heck, I think there should be a 10-yr hiatus on ANY new Law while Congress should be required to straighten out the US Code that we currently have with a limit on their product to 10% of the verbiage we now have including 100% removal of any phrases like “As the Secretary shall determine”.

I assure you, the Columbia River Gorge, is a federally protected area. That’s who the Gorge commission gets its authority and funding from.

Works for me. Along with a hiatus, we should have sunset clauses for ALL laws in the US Code. Give it Jefferson’s 19 year limit. Help weed out stuff passed back in the 1800’s that isn’t necessary or required.

Seeing as we're talking about Clark County, Nevada here, and the Las Vegas housing boom of recent years, they most likely sold their land to real estate developers and made more money than they could in years of grazing cattle on that scrub. Combine that with the fact that family farms have traditionally had a problem with kids not wanting to stay there and it's easy to see how the ranching operations could shut down.

Then there is “adverse possession”, which works for many.

Adverse possession doesn't appear to apply in this case.

First, under common law, one of the elements required to obtain title by adverse possession is 'hostile' use. That means you can't obtain title by adverse possession when your use of the land is with the consent of the owner. Second, under common law, another required element is exclusive use of the land. Without fencing, and with another 52(?) ranchers in the area at one time, I don't see how Bundy can prove, beyond a reasonable doubt, that his family's use of the federal land was exclusive.

Third, under Nevada law, color of title is required to obtain title by adverse possession. Unless Bundy can show a purported instrument of conveyance of title to the land in question, he can't obtain title by adverse possession under Nevada law.

Fourth, under Nevada law, to obtain adverse possession of land, all federal, state, and local taxes on the land must have been paid since the alleged date of occupation, or the claimant must pay them.

From your link: "The Gorge Commission is a bi-state Compact agency authorized by the Scenic Act and created by Washington and Oregon legislation in 1987. The Commission is funded equally by the two states and is comprised of twelve volunteers appointed by the counties and states."

Care to take a guess at how much it cost them to win that court case to keep their house?

Don't know, but I know that the Pacific Legal Foundation took their case for free.

Let’s not get lost in the weeds here.

Then quit pointing to the weeds.

It would be nice if someone was to post pictures that enable us to identify the thugs carrying guns, the snipers and the rest of them government cowboys. It wouldn’t take too much before we could identify where they live.

You know just let them sleep with one hand on the nightstand for a few months and see if they really want to be a G-man.

I only brought up the Gorge to demonstrate how the Federal Government has expanded its reach over western lands, that was my original point, one which you don't seem to care about. NGO'S and other quasi government bodies use the power of the federal government and the courts to drive farmers and ranchers out of business. Your original post was about how worthless this Nevada land was, nothing but sage brush and desert.

My point was this is about federal abuse and control. Back to the Gorge for just one point: U.S. Forest Service is in charge if the Gorge. (115,000 acres) The commission enforces the rules, set by the federal government, via the USFD
Similar to the BLM, they enforce policy, and they have everything to do with what happens in the gorge. I don't know if they have their own SWAT team like the BLM does, but I'm sure it's coming. Doesn't that disturb you at all?
