LOS ANGELES (AP) Vice President Joe Biden called on Congress Saturday to pass a measure to outlaw workplace discrimination against gays, saying it's outrageous that the country is even debating the subject.
Speaking to supporters of the gay advocacy group Human Rights Campaign on Saturday, Biden said it's "close to barbaric" that in some states, employees can be fired because of their sexual orientation or gender identity.
"Imagine 20 years from now as America looked back and say 'How in the hell can that ever been allowed?' The country's moved on, the American people have moved on," he said.
He said it was time for Congress to pass the Employment Non-Discrimination Act known as ENDA which would bar employers with 15 or more workers from using a person's sexual orientation or gender identity as the basis for making employment decisions, including hiring, firing, compensation or promotion. Religious institutions and the military would be exempted.

Apparently, the solution is to pass laws making it illegal to fire homosexuals. As an entrepreneur, what that means to me is what ever business I may be involved in will have no employees, gay straight or otherwise. That saves me from having some poofter sue me for firing it and eliminates the possibility of any accusation of bigotry. Problem solved.
What Biden is "overlooking" concerning his statement about Congress legislatively addressing remedies for workplace discrimination against gays is the following. With the exception of the federal entities indicated in the Constitution's Clauses 16 & 17 of Section 8 of Article I as examples, not only have the states never delegated to Congress, via the Constitution, the specific power regulate intrastate workplace issues, the states uniquely having the 10th Amendment-protected power to regulate such issues, but also consider the following. Neither have the states amended the Constitution to expressly protect so-called gay "rights."
So if Biden really wants the feds to have the constitutional authority to make laws which outlaw workplace discrimination against gays, this is what he must do. Biden must work with Congress to propose an amendment to the Constitution to the states which will expressly give gays the workplace protections that he wants them to have. And if the states choose to ratify Biden's amendment then gays will have constitutionally enumerated workplace protection and Biden will be a hero.

Here’s the other problem. I would be reluctant to hire an openly gay person if this passes, even if qualified. If I fire this person for work reasons, there’s a federal lawsuit.
