To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes.Congress has the plenary authority to regulate, therefore delegate.
So no, it was not "dreamed up." The legislative, judicial, non-profit, and for-profit activism regarding the Commerce Clause came later.
