SAN FRANCISCO (Reuters) - A U.S. judge on Thursday rejected Apple's request for a permanent sales ban in the United States against some older Samsung smartphones, a key setback for the iPhone maker in its global patent battle.
U.S. District Judge Lucy Koh in San Jose, California, ruled that Apple Inc had not presented enough evidence to show that its patented features were a significant enough driver of consumer demand to warrant an injunction.
Apple and Samsung Electronics Co Ltd have been litigating for nearly three years over various smartphone features patented by Apple, such as the use of fingers to pinch and zoom on the screen, as well as design elements such as the phone's flat, black glass screen.

Agree. I have the S4 and it truly is an amazing device.
I had an S3 until I dropped it one too many times. Now I have the Galaxy Note 3. Pretty amazing
But what counts in America is Samsung pays much better bribe.

I never understood the fascination with the Apple iPod. Way back when I bought my mp3 player for about $100 while iPods were selling for $300. They all did the same thing! Why would someone pay more for the same thing?
Same thing with the iPhone. Now everyone needs to be seen with them or an iPad when in fact the features of Samsung’s products are actually superior.
Never was a fanboy nor a fan of fanboys. Apple always seemed like a cult to me.

I have gradually been making the switch over to android devices, and away from Apple, but the Tim Cook comments also sealed the deal for me. I will never buy another Apple product now.

Apple needs to put its energy into winning in the marketplace and forget about trying to win in the courtroom.

I like the iPhone just fine, it’s iTunes I have a big problem with.
IF an alternative smartphone and/or tablet maker could offer a way to MOVE ALL of my iPhone/iPad/iTunes accumulations over to their devices - I'm gone tomorrow, or maybe even today.
