It still seems to me that bakers and photographers could avoid this problem by listing themselves as “artists.” Baking may not be very artistic, but cake decoration is.
I believe we have a long tradition of “artistic freedom” in this country, including the right to decide what work one is willing to do.
And if an artist is forced to work for someone they don’t like, then they can take advantage of their artistic license to....uh....make a statement.
My attitude is that there’s an easy way out of this that avoids a legal fight.
Christian cake makers should simply say, up front, that they’ll be more than happy to create the wedding cake. But every penny of the profit will be donated to a Christian organization dedicated to counseling homosexuals back into being heterosexuals.
The issue will immediately solve itself.
