Well, you can't win if you don't fight. FWIW I wouldn't blame him for disappearing into the woodwork. I don't know that he can prevail over the 0bama regime but I'm not sure, as you say you are, that he would necessarily fail. 0bama is beginning to fail on several fronts and the tide may be about to turn on him in a big way.

In any case what he said in this interview gives Holder no usable ammunition in a civil rights case. GZ has chosen to fight and I'll stand behind him for doing that.
