Aside from the fact that this is effectively a “loyalty oath” to government policy, how can one separate decisions based on unprofitability caused by the law from decisions motivated by the law?

How would one distinguish between “I fired them because my company would have been unprofitable,” and “Obamacare was the reason I fired them—because of the hit to profitability.”

Another problem here is that no court would ever analyze an individual case until “harm was done”—that’s the issue of standing. Meanwhile, the IRS, without any court supervision, could hassle thousands of businessmen. Would I be paranoid in thinking they might check their politics in selecting who to bother?

The intent is to make all businesses COMPLICIT in this fraud called Obamacrap, as are the previous unconstitutional actions of this Administration.
Obamacrap is pure "Bait and Switch ", sold by a liar, and is a lie in itself.
This Administration considers itself above the law , ignoring laws with which it doesn't agree,
and writing legislation through departmental 'guidance' and Executive Orders .
Writing legislation rests with Congress , and Congress alone; any legislation comming from elsewhere is unconstitutional and illegal .
Period !!
The _resident wants business to perjure themselves, after the fact , ignore the capitalistic purpose for being in business in the first place ,
clearly indicates the administrations domestic policy closely mirrors their chaotic international policies.
It has a name : Anarchy by purposeful ignorance.
You can tell that the 'Clown Prince' has never worked in industry ,retail , or a comercial business.
He just promotes anarchy and chaos.
