Man Charged With Killing Burleson County Deputy No Billed by Grand Jury

WASHINGTON COUNTY A Burleson County Grand Jury declined to indict the man who shot and killed a Burleson County Sheriff's Deputy who was serving a search warrant in December.

Investigators were executing a search warrant at Henry McGee's mobile home near Snook when the shooting happened.

News 3 takes a look at why deputies had targeted McGee's home.

28-year-old Henry Magee is no longer charged in the shooting death of Burleson County Sheriff's Deputy Adam Sowders.

A grand jury decided there wasn't enough evidence for him to stand trial on the capital murder charge.

McGee admitted to shooting Sowders before sunrise on December 19th while the deputy and other investigators were serving a no knock search warrant for drugs at McGee's mobile home near Snook.

He won’t be charged with murder, but they are throwing the max on him for three marijuana plants, and he will likely do all 15 years for those three little plants.

Sorry for the deputy and his family but, play with fire and you will get burned.

No knock raids are asinine and invite disaster.

Further, they violate the Bill of Rights.

Tragically and moreover, common sense and a reasoned approach were never given the slightest consideration.

His boss, his buddies and bosses all the way up the chain of command are responsible for this man’s death.

They went in to “suhprise” their “target” and Waco happened.

They have chosen a paramilitary approach to feed their egos and chase their next high from pretending they are at war.

As others have stated they did “no” recon or the barest of surveillance, save looking up the house on Google Maps.

This can’t be allowed to continue.

LEO should have to work for their money and do real police work.

They should never put their lives and the lives of fellow Americans in danger unnecessarily.

If a cop needed to arrest me they should feel free to knock on my door or send a letter informing me I have a warrant.

I’ll happily comply or turn myself in.

It’s not like I’m gonna outrun the back of a milk carton, Motorola or the Internet.

Stop No Knock raids. They are insane.

The SWAT Team found less than five pounds of marijuana plants growing inside and the grand jury indicted him for possession of marijuana while in possession of a deadly weapon.

I found that interesting. Would a legal gun owner, then, automatically incur a more serious drug offense because of owning a firearm? Or did the guy not have a permit/license for the weapon?

To shoot himself 7 or 8 times in the back of the head, would require epic proportions of remorse. I wonder if he would also pick up his own brass before croaking?

there is a guy in California, a democratic operative named, I think, ira schenker. his girlfriend was found hanged by the neck with her hands tied behind her back. was ruled a suicide.

I am thinking they will have him killed in prison, by another inmate who they will make a deal with for bennies and “considerations”.

His lawyer is right. What was he going to do flush several plants in five gallon pots down the toilet? Or get into a shootout over a relatively minor offense? Not likely. This midnight armed assault needs to stop.

I'm amazed that he wasn't shot down by the other sheriffs though. How did that happen?

Magee's Defense Attorney Dick DeGuerin says his client thought someone was breaking into his home and fired to protect his pregnant girlfriend and himself.

Although I totally agree with the Grand Jury in no billing this man and that I totally disagree with No Knock Raids, I will say this in defense of the police swat team in the arrest of this man; they showed excellent restraint in not shooting the man dead after he fired his weapon.

I am pleasantly surprised that this man lived to be charged in court.

This midnight armed assault needs to stop.

I agree with you and the man’s lawyer.

Why don’t they simply catch the man outside his home when he comes home from work and serve the warrant it they are worried about an armed resistance?

It seems to me that the way they do these No Knock Raids heightens tension on the cops and the subject. When some one is wakened out of a dead sleep by the sound of someone breaking down their door the adrenaline rush tends to bring out the guns.

I agree with you that the other officers showed a lot of restraint. There must have been a few precious seconds where the guy realized they were cops, put down his gun and put up his hands before the other cops got eyes on him. All a situation that doesn't need to occur as we've both agreed.

No-knock warrants are nothing more than armed home invasions. Save them for hostage situations, known psycho-killers, terrorists and be 100% sure of who and where.

The deputies were “amateurs!” They needed to go to Chicago for “no knock training.”
