If I have a "non-compliant" stove (heating my house), and the EPA wants to confiscate it, fine. The only caveat is that they heat my house in a more efficient way that THEY provide, and pay for. Then everything is cool (except for the tax payers).

If not, then all bets are off.

They won’t confiscate it. They will fine you if you are caught burning on ‘no burn days’ and will make it illegal to sell the home with the non-compliant stove in it. That is the way they have done it in California.
