Never heard of a .35 caliber pistol. Looked it up and .35 caliber is a rifle round, the .35 Remington.

You’d be harder pressed to find one that is actually 38 caliber instead of 35.

The guy was 72 so he was born in 1942. .35 caliber ammo has not been made since 1924. Sounds like this S&W was a family aireloom, less than 9K were ever made. Obviously this guy was not some heavily armed dude. But then a toy gun would have spooked this rookie who probably had his gun drawn and was seeking a burgler. Cops need more judgemental shooting training then they are currently getting, especially in smaller towns. I bet some lawyer will sue Tarrant County for not training it's officers adequately. I am sure that officer Hoppner feels terrible and will regret that action for the rest of his life. OTOH he did F up. But then don't we all.
