I got an email from an Aggie buddy yesterday about that settlement.


The courts say the Aggies own the 12th Man. The trademark issue was settled in 2006, months after Texas A&M lawyers asked a federal judge for a restraining order against the Seahawks, whose fans were proudly taking their nearly three-decades-old 12th Man tradition to Super Bowl XL, which the Pittsburgh Steelers won 21-10.

Seattle paid Texas A&M $100,000 in a lump sum for licensed use of the 12th Man concept. The NFL franchise can’t display “12th Man” in any official merchandising, though they can use the No. 12. The Seahawks also pay A&M $5,000 annually as part of a deal that’s been extended to 2020, but there’s no extra money in it for the Aggies with the Seahawks in the Super Bowl on Sunday.

A&M trademarked the 12th Man in 1990. Cook said there’s no way to know how much money the trademark brings the school in licensing fees, but “it’s priceless.”
