Should he have been notified of his right to talk to the consulate? Yea. Would it in all likelihood have changed the verdict and should that fact therefore be cause to set aside the sentence? No. They caught him running away with the murdered cop’s watch.

I disagree. He was a foreign national inside the state of Texas committing a crime. The only “rights” he has are those enumerated in constitution and laws of the state of Texas for foreign nationals. If Texas law did not afford him the “right” to talk to the consulate, then he did not have that right.
