DEA operations chief decries legalization of marijuana at state level

The chief of operations at the Drug Enforcement Administration on Wednesday called the legalization of marijuana at the state level “reckless and irresponsible,” warning that the movement to decriminalize the sale of pot in the United States will have severe consequences.

Capra’s comments marked the DEA’s most public and pointed criticism of the movement toward decriminalization in several states, where local officials see it as an opportunity to generate tax revenue and boost tourism.

“It scares us,” James L. Capra said, responding to a question from a senator during a hearing focused on drug cultivation in Afghanistan. “Every part of the world where this has been tried, it has failed time and time again.”

Capra’s comments marked the DEA’s most public and pointed criticism of the movement toward decriminalization in several states, where local officials see it as an opportunity to generate tax revenue and boost tourism.

I have read that the legal states include a 6-plant allowance for growing one’s own without tax or penalty.

They probably don't want their kids downing a six-pack before school either, but that doesn't mean Prohibition itself wasn't worse than having alcohol legally available.

I didn't ask about beer I asked about pot but if you don't want to answer the question so be it.

Why would you sell anything of small dollar value to your grandchildren? Do you sell them Christmas presents? Sell them breakfast cereal? Do you create invoices of billable hours, when you visit them?

Unfortunately, I have no grandchildren. If I did, they would be old enough to find pot in the schoolyard, workplace or from a friend. Am I freaked by the thought of children smoking or eating pot? Not really. I am aware that they already have access to it, see their parents smoke it and can watch it being sold and smoked in movies and on TV.

I don’t like the thought of toddlers and young children smoking, since they are not psychologically or physiologically mature.

Pot hasn’t been something sordid and underground since sometime in the 1950s. It is mainstream. It is only those of us without young connections who cannot find it easily.

That horse left the barn about 40 years ago. It now runs free with Federal and some State approval. The only Federal complaint, IMO, is that they want to control all revenue sources and keep the DEA budget while not allowing the States their 10th Amendment rights. They also like the control of having the ability to levy criminal charges on people when it suits their agenda and pot is an easy way to do that.

Reputable studies and personal observation pretty much discredit all the scare stories about it. It is a new source of revenue for government. It’s here, now, and ubiquitous. It is hypocritical to rant on pot availability when all the tranks and speed-like drugs are practically forced on anyone with any anxiety, stress or performance issues, including 5-year-olds, with the sanction of the State.

There are a lot of things in society that are not all right with me. However, I have zero power to do any more than try and live out what is left of my own life as removed from that society as possible. Even a hermit can observe, however.

Your attempt to guilt trip those who aren’t hyperventilating over legal pot is fairly lame.

I do agree with him. If it is to be legalized it has to be on a national level, and I could only support that if we had a good test for level of impairment for driving.

You're operating on a faulty assumption here: that the illegalization is itself legitimate.
To enact similar regulation on alcohol the Constitution was amended, yet no such amendment exists WRT drugs.
Moreover, the power used to claim the authority to regulate drugs is the interstate commerce clause; which is the exact same clause regarding foreign trade.
To legitimize the War on Drugs the courts have transmuted the interstate commerce clause into an intrastate power, indeed to the point where non-commerce is regulated [under the commerce clause]. (See Raich)

Interestingly, if the federal government tried to regulate foreign countries as it does the states, such would be considered an act of war... and the enforcement of such policies would be (a) the waging of that war, or (b) the victor's subjugation of the defeated. — The Constitution defines the waging of war upon the several states as treason.

Is a reformed conservative someone who doesn’t think the Ninth and Tenth Amendments should be respected? Where in the Constitution is the DEA authorized to exist?

Agree, It is a states rights issue. However I do think the smuggling of contra band across borders is a FEDERAL matter.
