Father pays outstanding child support, still gets jail time

HOUSTON (FOX 26) -

Clifford Hall says he's more than happy to pay child support for his 11-year-old son.

"I'm his father it's my responsibility to take care of him," Hall says.

But Hall says when the amount of child support was modified no one told him.

"I discovered for some reason his employer was withholding a large amount some weeks a small amount some weeks a zero amount some weeks," says Hall's attorney Tyesha Elam.

"I didn't want to go to jail basically," Hall says.

So Hall quickly paid almost 3 grand in back child support.

1. If a payer (in this case, the dad) is incarcerated, the child support is abated (he doesn’t have to pay for the time he’s in jail).

2. Having a payor in jail in not “in the best interest of the child”.

3. Really, the dude got 6 mos. for disrespecting the judge.

4. It is up to the Friend of the Court to notify payers of all court proceedings. In this case, either Dad simply didn’t get notitifed, his attorney didn’t get notification, or the both of them are really, really dumb. My vote is that the court did not notify them.

5. The employer should be held liable for the “a lot this week, not so much next week” method of payment.

Summation: This guy is getting screwed by the system. His attorney should refund any payment he’s received. The employer should be charged with withholding payment. And the judge needs to get over herself. And who is deprived out of all of this? The child. Sorry, in this case, it is all about the children.

It was. He stammered a bit. I said “I’ll accept a simple ‘I apologize’ and then we can move on to the business at hand. I figure the purge will be about $1300?”

It was, and off she went in cuffs until she scraped it up. I really don’t know which aspect I liked the most.

I read a report a while back that said in DC the average time served for murder was 7.5 years and for armed robbery of a convenience store it was 5.5 years...

Great motivation for the robber to shoot the only witness.

Does not apply at all to child support discussion.

My sons ex-wife was ordered by a court in Texas to pay child support as well as provide insurance for my grandson. She does neither. She lives in New Mexico at an address that we supplied to the AG. He receives no money and I pay for the child’s insurance. We pushed all the buttons that we know of...to no avail. The system doesn’t always work.

Wish I had been there to see that. I do enjoy when a self-righteous idiot is forced to eat some crow immediately after their spiel.

Was talking to a guy who was an organizer for a gun show near a city's airport. He was telling about a call he had recently had from the city tax office screaming at him over not filing required sales tax paperwork with the city, and how he was in such enormous legal trouble.

The organizer took such pleasure in telling the tax guy "The site is just across the border in [adjoining suburban county], f***head", and hanging up.

It sounds to me like he was in a show cause hearing and walked out. You don’t get to go until the Court says so.

Sage advice. The “Family Courts” are so out of whack a man doesn’t have a chance. I should note that in the instances described above, I had to force the court to do something about her delinquencies. They would never have bothered to try to collect, left to their own devices.

A friend of mine got divorced from his bipolar wife. She got the kids and he dutifully paid child support for several years. Then the kids decided they would rather live with Dad, and they were cramping her dating style anyway, so she agreed to give him custody.

He asked me if I thought he should ask HER for child support. I told him, "do you REALLY want to give her a reason to not go ahead with giving you custody?". At least this way he stopped paying child support to her, while still having to buy the kids clothing, school supplies, etc.

You dudes make more money driving a freaking truck or digging a ditch or running some backhoe than these poor gals can make with their little $10 an hour office jobs. What kind of union jobs do women have? None. Still. Even with “women’s lib” which is really men’s lib because now y’all can mess around without any condemnation. If you are treating your child’s mother poorly, you are setting a horrible example for your child.

The safety manager in the plant I worked for was forced to pay child support for a daughter who had enlisted in the Navy and had been out of the house for a year........

Several years ago I dated a woman whose ex was supposed to provide payments as well as health insurance for her daughter but he had stopped over a year prior citing he had gotten laid off from work. In the meantime, he was obviously working under the table since he was able to purchase a new house.......

The Friend of the Court is a circus and stories like these are the norm.........

You have no freaking clue. It costs a fortune to have to go into court for the child support and these jerks quit jobs, hide out, move, change their names just to avoid paying.

Miniscule? Most of them are 20k or more in the hole.

It works both ways bro.......See my last comment regarding my ex girlfriend.......

While women have advocates to help them through the process, men do not.

My friend's "legal advocate" required $3,000 up front in order to support her in the Friend of the Court.......

She couldn't afford it so appeared before the judge herself. Other than the judge siding with the ex-husband's claim that he was unemployed and couldn't pay the child support or provided the required insurance for the daughter, she remained screwed while her ex was free to get drunk........

Child support is not taken out if the father has been paying. NOT NECESSARILY. IN KANSAS IT’S REQUIRED NO MATTER WHAT IF THE OBLIGEE WANTS IT TAKEN OUT OF THE PAYCHECK
Having said that, sue the employer for their failure to remove the required amounts MAYBE
