It should be a persons right to refuse blood or breathalyzer.

Believe it or not, it is your right in Massachusetts.

However, if you refuse, your license to operate will be immediately suspended for 120 days.

As it should be.

The issue is whether your constitutional rights to NOT provide evidence against yourself is violated under this new law.

In Texas, a few years back, refusing a breath test was treated like a DUI. As it should be. If you are driving while drunk and refuse a breath test, you should have your lic suspended and treated as harshly as if you were DUI.

Something about “The State”, holding you down and forcibly taking a blood sample. Questions remain in regards to DNA databases and so forth as well.

Just creepy!
