That is because this only needs 51 to pass Senate. Exactly. He'll cobble together the RINOs who are facing reelection in 2014 to "vote" against it, so the safe RINOs who aren't facing reeelction can vote for it. Voila! It passes, and Reid puts a sugar cube in McConnell's mouth.
