I think the background in the excerpt supports the suspension. He was warned, he has other behavioral issues, and a mother who does not seem to take his behavioral problems seriously.

First, the suspension isn't what is controversial:

School officials in Canon City are accusing Hunter Yelton of sexual harassment and they want it on his school record.

Second, he is a 6 year old boy in a system that doesn't respect the needs or energies of boys.
