Who voted what ?
Short version: Roberts and Kennedy voted to deny a stay, but didn't write any opinion. Scalia, Thomas and Alito also voted to deny a stay (creating the 5-4 majority), and joined in an opinion written by Scalia (which basically says that a lower court's decision shouldn't be stayed unless it is clearly and obviously wrong). Breyer wrote a dissenting opinion, which was joined by Ginsburg, Sotomayor and Kagan.
Four conservatives and one moderate sided with the Constitution of the United States of America. Four liberals sided against it.
Lurking Libertarian’s brief summary was entirely correct as far as it went, but it omitted the thorough evisceration Scalia performed upon Breyer. It’s well worth reading. Breyer’s dissenting opinion is only five or six pages, and I read it first in order to have it in mind when reading Scalia’s even shorter opinion. Complete beat-down.
