Obama still misses the mark: HIPAA prohibits health insurance cancellations

President Obama continues to miss the mark. Federal law already prohibits insurance companies from cancelling policies, and his “fix” is a flop.

Millions of insurance policies are being cancelled throughout the country, as reports confirm. Democrats were aware this would happen under the new Obamacare law. However, these millions of insurance policies should never have been cancelled.

Federal law prohibits their cancellation.

In an interview with The Washington Times, C. Steven Tucker, a health insurance and Obamacare expert in Illinois, explains that the HIPAA law section 2742 (Health Insurance Portability and Accountability Act of 1996) does not permit these insurance policies to be cancelled. It has been illegal since 1997 to cancel someone’s health insurance coverage when you are sick or when you have claims.

Healthcare.gov is also not in compliance with HIPAA regardless of the site disclaimer.

lawsuits are getting ready to fly.

I've said from day one this is a "full employment" bill for attorneys. Way over and above the ones IRS hired to administer the law.

The government bureaucrats are always eager to ignore laws and increase the risks to the folks when it is convenient.

Example: mercury in CFLs. They mandate a law that increases the risks to the folks and ignore the EPAs recommendations for the risks of CFLs.

Remember: it is all for the betterment of the collective. Some people will suffer, some people will lose their insurance, some people might even die, but we will all be better once Obamacare is completely implemented.

They aren’t really canceling them. They are just not renewing them with the new year.

But if you’re not sick and don’t have any claims they can still cancel your policy. That’s still a lot of people effected.

One other falsehood that people bring up is when you are laid off from a company, you lose your insurance. Here in Colorado, we have COBRA and you are allowed to continue your insurance. You have to pay for it, of course. And it can be really expensive.

I don't know if this is a law or one of the severance perks.

Who knows, maybe they mean that the company continues to pay your premium after you have been laid off.

I think the insurance industry is regulated by state authorities so it is probably illegal for the Federal government to enforce mandates in any case.

That's not what the HIPAA section actually says. If a product is being terminated or the insurer is pulling out of the market, the policy can be cancelled provided certain requirements are met.

That said, I have no doubt this will be a field day for lawyers, especially after the stunt the Prez pulled today.
