How To Skip Out On Obamacare Without Being Fined

I will be submitting a new W-4 form to my employer. At the end of next year I will not be owed a tax refund from the federal government. As a patriotic act of disobedience, I am proudly refusing to purchase any health insurance. This would mean that I will be subject to a fine of 1% of my total income (2% the following year, 2.5% thereafter). The awesome thing about that is unless you are due a tax refund, the government will never see a dime of that money.

My choice to not buy health insurance is a choice many people are going to make, either to protest, or once the ObamaCare website is properly up and running and they get a glimpse at the increased cost of the monthly premiums under the Affordable Care Act. During his radio show recently, Rush Limbaugh went into detail about all of this:

Anyway, [my accountant] said to me that, according to the law, the only way that the government can collect the fine or penalty for you not buying insurance is if you are owed a tax refund. If you do not owe a tax refund, they cannot go into your bank account or anywhere else and get that money. Now, the sad thing is that most people file their taxes to get a refund ’cause they think they’re screwing the government, and they’re not. …

Therefore, the only way that they can collect the penalty or the fine is by taking money from your refund. If you are not owed a refund, they cannot get money from you. They can’t issue a lien. They can’t garnish your wages. They can’t use any of the normal procedures available to them if you owe them money, even though the Supreme Court has said it’s a tax. So for those of us — I mean, folks, I’m in fat city. I’m in fat city because I always structure to where I owe money. Well, not entirely. There have been years. But if you structure your taxes so that you do not get a refund, you do not have to buy insurance and you do not have to pay a fine ’cause they can’t collect it from you if you don’t have a refund due.

And that is just another nail in the coffin of Obamacare imploding on itself.

Limbaugh also highlights that in order for ObamaCare to be successful, the program must coerce a few million young, healthy suckers into paying for something they don’t really need. All I need is a catastrophic plan in event the unimaginable happens. Unfortunately, Obama has banned affordable catastrophic plans and is utilizing the mandate as a way to force us into paying for services that we don’t all need like maternity, vision, dental, mental health, and drug and alcohol treatment.

As many as 20 million people could lose their current health insurance coverage because the coverage they are currently happy with has been outlawed under ObamaCare. These ObamaCare victims are certainly going to face higher premiums which they might not be able to buy, or just don’t believe are worth the potential of a 50% to 150% premium increase with a higher deductible.

Remember that you don’t have to pay a fine if you legally ensure that at the end of the tax year you are not owed a refund from the federal government.

I do not get my advice from some “guy on the radio”...Did you hear some guy say this on the radio???

Your subtle mention of the “Infernal” Revenue Service, in this case, tells me YOU are just as fustrated with this situation as others are, or your choice of words would have not carried such ambiguity...

Again, what mechanism in the “law” says that there is a collection/enforcement beyond garnishing your yearly FEDERAL income tax return “refund”???

YOU, or anyone else tell us, and prove to us by statute, where these provisions are, and I’ll be glad to discuss that with you or anyone else what the course of action should be at that time...

Your assumptions give away your lack of virtue, the likes we have not seen since the founding of this Republic...Those “loyalists” either laid low, weathered the storm (during the establishment of this Constitution/Union), but later resurfaced and became complicite with the efforts to subvert the basic freedoms and liberties, so many people better than you or I, gave the ultimate sacrifice for, to stave off such a political and social condition we live in now...

Wow, that almost sounds like a threat to me...Since this indicates you have given up, and will comply with such a “Tax” on this country, that you’d be part of a movement to inform on your nieghbors who do not wish to comply with such a form of communism, that you become the nighborhood commissar???

I’m sure you wish to argue these point, but your previous words speak for themselves...And are part of the public record...As are mine...

I eagerly await your back-peddling...;-)

You are not...AS the law was written, there are no provisions anyone I know, who have found any mechanism or collection/enforcement agency that can garnish beyond your Federal income tax return (refund)...

I have asked repeatedly and have been parusing this vacuous document in my spare time, along with a few other folks, to find something in there that will refute our position as it stands now...

There are some who would comply, regardless of finding it within a “law”...

But the secret to “law” is that if there is no penalty, where exactly is the provisions for punishment, fine, levy, or other garnishment of your personal property or freedom???

Of course, the narrow provision to fine you by garnishing your tax return check is something they very well can do, but if you do not have any refund coming to you, and there is nothing in the law, as it is written now, in there to go after you after the fact...

You have to ask yourself, why should I do anything to help communism out by complying with such an immoral law???

There are a lot of people, even in this place that are crawling over themselves to comply...

What an absolute shame!!!

Just be careful of where their information comes from...We have a slight level of anonymity here in this public forum, but I feel our positions will be made suspectm by some folks here who are not willing, either they are tired, or never were onboard fighting this Tax...

They are the new “loyalists”...And they are dangerous to all of us who oppose the trampling of our freedom and liberties...

In addition to the Tax Court, federal tax matters can be heard and decided in three other categories of courts: U.S. District Courts, the Court of Federal Claims, and the Bankruptcy Court.[29] In the first two instances, the taxpayer bringing the claim generally must have first paid the deficiency determined by the IRS."

Well, duh. If the taxpayer has not first paid the tax, the IRS and/or the Justice Department will bring charges (one case I'm aware of occurred in U.S. District Court). If the taxpayer has paid it, then yes, the only way to recover is if he sues for it.

Actually it is a standing issue. If you haven’t paid the tax you have not been harmed so there is nothing the court could address. You could also wait until the IRS levees the fine and sue at that time. Its a jurisdictional issue.

penalties and interest on that $95 will probably end up being $4500 in a years time.

What we need to remember is, the penalty is not $95 but is $95 or 1% of your income, whichever is greater. If you make more than $10,000 per year your penalty will rise accordingly.

Actually the figure is, if you make more than $9,500 per year, your penalty will be greater than $95.

Took a few years of tweaking to get to the point where I am close to neutral as far as paying/getting a refund. Wife retired this year and will have to tweak again once we do our taxes. I retire next year and will have to do another tweak. I prefer to pay $100-$500 vs being owed a refund. You can bet they will tweak the withholding tables a time or two to “keep more money in your pocket” with the real end game of trying to ensure more folks are due a refund that can be tapped. Stay tuned in to changes so you can adjust on-the-fly.

Oh, I'm not back peddling on anything. I've seen lots of tax protesters think they can use the "law" as a shield. I'm out of the business of trying to save people from themselves. If you want to live in a fairy tale world where that fever swamp on the Potomac operates within the confines of the constitution and law, knock yourself out. I don't have to prove a damned thing to you or anyone else. A lot of the chest thumping I've seen from people who pontificate about how the IRS is powerless to extract those fines are people who already have insurance and won't be subjected to them anyway.

I'm not going to ask you to show me any kind of law to prove your claim. Just show us all how easy it is. Please. Do it. You'll either have to submit a 1040 that you know is inaccurate, which opens you up to perjury or you short the amount of the check you send them, for which they will come after you, hammer and sickle. But feel free to be an example to the class and show us how to tell the revenuers to get bent.

I was ready to just give you a GFY on the loyalist bullish*t but you seem sincere so I'll let it go. I still think it's bullish*t, two dimensional drivel. I have no loyalty or fealty toward fedgov. The last chance to rollback Leviathan was over 10 years ago. That opportunity was lost forever when the party of "smaller, less intrusive government" decided they wanted more cowbell turned up to 11 when it came to big government. Crack a history book or two and you'll see that this is going to get very messy. If you want to be a martyr and march into Leviathan's arc of fire when he's at his strongest, feel free to be cannon fodder.

In normal times that would hold true.

But when has the Harry Reid Senate or the Barack Obama administration concerned themselves with what is legal or illegal?

Never once has ANYONE EVER suggesteed submitting a false, or incomplete accounting of your income to Uncle Sucky...That assumption on your part, that that is what this is all about is FALSE!!!

You want to believe some people live in a fairy tale world is another absolute non-starter for your side of this discussion...But like you, I can rise above the playground mentality illustrated by some in these discussions...

If you want to classify all of us as chest thumping idiots, instead of looking at the merits of the effort, you definitely are running with blinders on...

I, and many otherrs that are looking at this and doing things to make this happen, do not for one second believe it will go unanswered...

I would love to come back in about, let’s say 12 months, maybe even a year and a half and tell anyone that will listen that we were either successful, or we will hear about stories of people getting humped like the nieghbors dog by the Federeal government for forcing them to make the changes to the law to allow the investigation and prosectution of those of us who are playing the system...

Obviously, playing the system is fine for those that have the money to dio such things and do their best to keep as much of their money as possible, instead of giving it to a corrupt government that is growing expotentially and more intrusive in EVERYONE’s lives...

You state you have no love for them...Ok, I can dig it, the proof will be in the pudding at the end of the day...

I hope we get to revisit this issue in the future, and I honestly want to tell you most of all, and a few others here that for all intents and purposes have illustrated to me that they are un-willing to fight Goliath...

Personally, I kinda like our odds...I feel a lot like David...And in the end look how things worked out for him...Multiply that by a few million people in this country...

BTW, all you have to do is pay the minimum on an amended W-4 where you work, or go to your accountant that handles your private business affairs, and work it out to break even as close as possible for the next two years...

I believe in two years, this whole issue of the Affordable Care Act (ObamaCare) will hopefully be collapsing, and those of us who decided to hunker down and not support it for any reason, will be a big part of it...

Obviously, we could not depend on those folks in D.C. to get this done...

Like I said, They who laugh last, still laugh...When all is said and done...

I pick my fights wisely. David had it easy. One rock, one Goliath. Done. Our odds aren’t that good. There is a word for people who would have tried to stand up to hitler during the torch rallies, right after the invasion of Poland or taking his victory lap in Paris... I believe that word is “stupid.” Even his own generals didn’t try to move on him until that regime was much weaker, and you still see how things worked out for them. For me, I’m not going to be throwing eggs at der fuerhrer’s car during the parade.

You ask me to read history, or other books that describe situations like this??? Well, all I know is that I, and many others do undestand what is at stake here, and if you and your kind do not wish to engage and stand up to the evil before us...

All I will say is that in a year and a half we still have the means to communicate to each other...I will not rub your nose in it, but be advised, my sympathy for your particular suffering in the interim, will not be readily apparent...

And for the record, I do not throw eggs...

BTW, with your position, we will all lose, from our perspective we are doing something that may very well effect the kind of change that all can benefit from, instead of lying down in the dirt, and taking lashes for doing nothing...

18 months is not very long...We will see where things stand at that time...Who knows, maybe no one will survive this...
