SANTA ROSA - Santa Rosa police released more details today in response to persistent questions about the fatal shooting of 13-year-old Andy Lopez by a Sonoma County sheriff's deputy in southwest Santa Rosa last week....
Henry said Gelhaus said he knows he yelled at least once to Lopez to drop the rifle, but Gelhaus said he is unsure whether he identified himself as a sheriff's deputy.

LOL! Okay, I’m moving away from this thread. The way you frame your argument made me change my mind. Hang the friggin’ Sheriff from the nearest tree. LOL!
Without the identification, the kid might have thought it was a joke.
No dice. Based on the facts thus far the kid was walking away from the direction of the cop who didn’t identify himself or give the kid enough time to comply with an order.
Cop erred.

Glad to be of service!
If police officers often use their open car doors for cover, then why are the doors not reinforced to prevent bullet penetration?
FReepers are usually a great judge and jury and we are right, but the jury is out on this one.
He was shot 7 times in his right side — so at best the pellet gun was pointed at a 90 degree angle from the deputy.
A well regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.
I hear what you are saying, but it is a shame that we have yielded our right to keep and bear arms. In a Second Amendment world, the boy should have been able to carry an authentic AK47 without fear of being taken down by assailants who were offended that he was exercising his Second Amendment rights.
A cop making an 'error' is, for instance, dipping his donut in Pepsi instead of coffee.
Shooting a boy SEVEN times is not an 'oooopsie', it's MURDER.
Who was using a bullhorn?
He erred with fatal consequences. I agree it’s murder.
You, good sir, have posted the best post of this topic!
Amen!
The way I’m reading it, the kid was walking against traffic on the left side of the road. The cops pulled up behind him and into oncoming traffic. When the kid turned towards them, to his right, he was shot on the right side 7-8 times. I’m seeing him only turn 45 degrees or so before the bullets start impacting. 90 degrees would point him towards the street, 135 degrees would face the cops at his 4 or 5 o’clock. That shooter is a fast decision-maker.
There was no AK-47. There was no gun.
If the officers had thought for more than a millisecond he might have been able to figure that out. This is a case of shoot first, look second.
Instantly shooting someone because they look suspicious is not what we need or want in this country.
Yep you can't retire from the force knowing that you are the only person that you ever shot on duty.

I was surmising.
However they yelled or whatnot over the din of the traffic, how would they not expect the person to turn around and look?
For at least the tenth time on FR, I TRY to support the cops as they are as necessary as breathing to a society. But, darn, these guys (meaning all cops everywhere) just can’t go around pumping ten rounds into kids and old men and single moms because they THINK they feel “threatened”. Bullshit! If your gonna pull your glock out and pump ten rounds into a kid you can’t “THINK” your threatened, which common sense and a modicum of intellect demand, you have to”KNOW” your threatened. Otherwise, if your GUESSING is wrong, as it was in this case, you’ve just committed a murder.
Speaking for myself I know there is no way I would pump 10 rounds into a kid unless he actually shot at me. Yes, I believe that the cop, when in doubt, MUST wait until the suspect makes SOME OVERT MOVE!!!!! He can’t just OPEN FIRE because he is scared for his life at a “figure” in the distance that by his own admittance he is uncertain of. If your going to be THAT SCARED in “THAT SITUATION” you are in the wrong profession. You MUST be strong enough and discerning enough to hold your fire, even if for just an instant, to verify the situation and not GUESS. GUESSING RE LETHALITY IS NOT GOOD.
And, I’m sorry but “I’m sorry” and “i apologize” just doesn’t cut it”. A kid is DEAD !!! And that is forever!
Aren’t cops trained to empty their weapons once they start shooting? Perhaps this ROE needs to be changed? One shot into lower extremity then wait for perps reaction before finishing him off?
