Household key to tax subsidy under new health law

Readers had lots of questions in response to my columns last week on the Affordable Care Act, especially about what constitutes a household.

I'll answer them below, but first remember that under the law, a household generally includes anyone listed on the same tax return.

To determine whether you are eligible for a tax subsidy when buying health insurance on a state-run exchange (such as Covered California), you generally must include the income of everyone on the tax return. One exception: If a dependent on the return earns income, but not enough to file his or her own tax return, the dependent's income is not included. However, that dependent will be counted as part of the household to determine poverty thresholds for your family size.

We have become a society where it is important to figure out how to game the system to make others pay for my health care. It seems that the Obama Administration is on board and actually enabling this process. I will make it my duty and actually an obligation to game the tax system this April to compensate for this.

Keep in mind that the Obama administration also believes in selective enforcement of the law.

I know people who “divorced” years ago because of tax burdens, of course their living arrangements and lifestyle never changed and they still refer to each other as husband and wife.

Blah, blah blah about the premiums. It’s the deductibles and co-pays that really determine access to healthcare. The low income people will likely choose the bronze plan which have high deductibles and co-pays. And, because the lower income people are poor credit risks, they will need to pay for those deductibles up front or no service. Add the fact that we don’t know how many providers will actually accept 0-care exchange insurance and you will have a lot of people that won’t even be able to reach their deductible. And even if they go to the ER, they will still need to meet their deductible before the insurance kicks in.

I can see how that’s an attractive offer. And now Obamacare encourages divorce or never getting married and living together. The tax savings are, IMO, well worth it.

As for us we are definitely not signing up for Obamacare and are trying to figure the best way to avoid paying any penalties.

Well you can always do what our “undocumented” brethren do, go get some new ID’s and start living under them (think of all the “free” stuff you can get)and if you get caught say no habla and go out and buy a new ID and start all over again.

Democrats and Liberals have always gamed the system maybe even to the point of cheating. The laws are subjective — it is what “progressives” do.

Conservatives tend follow the rule of law and take the law literally.

You don’t need a wife. A dependent will do. Anyone you say you support. Lots of boyfriend/girlfriends are able to do that now. Along with their kids.

If the cost of healthcare without a subsidy is more than 9.5% of your MAGI, then there is no penalty. Also, there is no penalty due if you are in danger of foreclosure or eviction or if you receive a turnoff notice from a utility company, at least for that month. Lots of ways around this abomination.

Thanks. My tax guy used to work for the IRS so I’m hoping he can provide a lot of options for me. Even if there’s a penalty I think there’s additional legal ways around not paying it. Abomination, indeed.
