Legally, you cannot say “A 13 year-old cannot give consent unless they can”.

Consent is the legal term for being able to choose to have sex.
Voluntary is simply a description of their choice to engage in a prohibited activity. That the act was voluntary does not remove the legal prohibition against them having undertaken to participate.
