NCAA calls lawsuit 'misdirected' [Paterno family lawsuit should be tossed]

HARRISBURG, Pa. -- A lawsuit against the NCAA by the family of late Penn State football coach Joe Paterno and others is fatally flawed and should be thrown out, the organization said in a court filing Thursday.

The filing in Centre County court said the suit contains "sundry misdirected complaints" and argued that the plaintiffs don't have standing to challenge the consent agreement between the NCAA and Penn State over the child molestation scandal involving ex-assistant coach Jerry Sandusky.

"Plaintiffs resort to tortured interpretations of the NCAA bylaws and the case law in an effort to obscure two inescapable facts: they are the wrong plaintiffs and they have sued the wrong defendants," the NCAA wrote.

The lawsuit was filed by the Paterno estate, a few trustees and faculty members, nine former players and two former coaches, including Paterno's son Jay Paterno.

The NCAA said Paterno's estate was not able to say how its commercial interest in his reputation lost value.

"The NCAA is left to guess whether the estate has some cache of autographed footballs that coach Paterno signed before his death but, presumably, were not sold in the seven months between his death and the publication of the consent decree," the NCAA said.

You mean Tom Harmon, js’s neighbor, fellow church member, and all around friend? That Tom Harmon?

Ask John why the prosecutors didn’t call V2 to testify during the js trial. They knew damn well who he was. During the preliminary hearings for GS/TC/GS, one of the defense attorneys asked one of the prosecutors if they knew his identity, and (from eye witness accounts), he looked to his bosses and had an “Oh Shit” look on his face.

Everybody on campus knew what was going on at PSU. Penn Stste Creamery even had a phallic shaped ice cream treat called the Sandusky that they pulled once the scandal broke.

I find it amazing that people continue to defend the pedophile enablers who made it possible for Sandusky to prey on young boys for as long as he did.

Urban myth/lie that you apparently fell for. The Creamery (the best ice cream in the world, btw) doesn’t sell ice cream in any manner other than cones, cups, and 1/2 gallons/gallons. Never has, never will. They don’t sell “treats”.

They did have a flavor named after js - as he was a local hero. The second mile was the largest charity of it’s kind in the state, and George Bush named him one of the 1,000 points of light. I guess HE knew what was going on as well, huh?

You keep believing what you want though. It makes you look really lazy.

Rush was fooled by a picture posted on the internet that day. It was NOT a picture from the creamery. They don’t do sundaes, treats, sprinkles, etc. They only do ice cream.

For you to impugn the employees of the University Creamery like you did speaks volumes about you.

Like others, you ran your mouth with no research, without thinking.

BTW, if you’re in the Northeast this weekend, some of those same employees (students) are out “canning” for THON. THON is the largest student-run philanthropy in the world, and just last year donated $12.5 million to the Four Diamonds Fund for the cure to childhood cancer.

Open up your wallet if you see the students.

Then why aren't all of them being indicted. Knowing of a crime and failing to report is a crime in itself.

Why aren't the owners of the Creamery being indicted??? The Creamery appears to have been advertizing for him.

I suspect that most knew or suspected that he was gay but not that he was a pedophile.

I find it amazing that people continue to defend the pedophile enablers who made it possible for Sandusky to prey on young boys for as long as he did.

All the kids molested were from the 2nd Mile Charity which was run by a child psychologist with connections with the state and county's public welfare department.

You should be asking why that charity and its records were allowed to disappear into anonymity and one of its sponsors brought in to cover its trail -- yes I am referring to Louie Freeh, one of 2nd Mile Charity's financial backers.

Mike McQueary saw what he thought was sexual contact. He had an obligation to report what he thought was a crime.
Paterno heard a second hand report that was unclearly described. He did what was correct. He had witnessed no crime.

Chip - As a former PSU athlete, student, second mile volunteer, resident of State College - I have never, ever heard anyone state that they thought js was “gay”...that’s a non-starter.

js’s image around town was that of reverence because of the second mile. Everyone was fooled - which is why Clemente put him in the top 1% of deceivers/child molesters.

Do you really think the Creamery - who serves millions of cones and cups/year uses what appears to be some sort of Fiesta Ware bowls for all their customers? Uh. No. They use styrofoam cups and you are NOT allowed to mix flavors - which this picture shows. Think, dammit!

I don’t know how long he has had them but he has many of the mannerisms of a gay man.

Furthermore he is given a sweetheart retirement deal by a university president who said that he wanted to make Penn State the most gay friendly university in the country.

He didn’t molest young girls did he — just young boys.

People at “gay friendly” Penn State were probably taught to overlook things like that and see what it cost them.

Spanier barely knew who js was. I hated Spanier (like any conservative would) while he was President, but his knowledge of js and his proclivities is/was basically nil.

I guarantee that gay friendly Spanier knew who every gay person on that campus was. He may have kept his distance but he knew. And when it came time for a sweetheart retirement deal for Sandusky he was Johnny on the spot to give him a deal that keeps him and 2nd Mile around.

He sure did - not unlike most other college Presidents as well though. I just don’t see the connection between his liberalism and js.

The gubbmint didn’t either - as they granted him a security clearance after putting him through a pretty high level background check.

I’ll go you one further.

Spanier wanted to sweep this under the rug and deal with it quietly — not to protect the football program — but to protect the gay friendly atmosphere that he was creating at Penn State.

Afterall it’s not straights who molest young boys but gays and Sandusky’s crimes would expose him as a homosexual who had gone off the reservation.

According to Ziegler - who I trust in this - Spanier had to be reminded who js even was when he THOUGHT he was voluntarily testifying before the GJ (the subpoena was hidden by nutcase Cynthia Baldwin).

I think you’re reaching.

Ziegler - who is obviously a staunch conservative - actually likes Spanier, and considers him to be very truthful and forthcoming. They have talked and e-mailed back and forth more than most would think about this.
